1. Contractual bases

1.1 Stötzer Stadel GbR acts as an intermediary for fitters' apartments, fitters' rooms, vacation homes, vacation apartments and similar accommodation (hereinafter referred to as "fitters' accommodation"). The fitter accommodations originate from various providers, in particular tour operators, local agencies and private landlords (hereinafter referred to as "providers").

1.2 For the above purpose, Stötzer Stadel GbR operates an online booking engine. Which is used on its own websites as well as in variants on the websites of partner companies. (hereinafter collectively referred to as the "Website").

In both cases, the present mediation conditions apply. The booking engine includes, among other things, a search function, a detailed presentation of the accommodation for fitters with descriptive text, pictures, availabilities and prices, as well as the possibility to order the booking.

1.3 Stötzer Stadel GbR acts exclusively as an intermediary for accommodation for fitters. And mediates contracts on behalf and for the account of the providers. With the booking order comes between the customer and the Stötzer Stadel GbR an agency agreement. The object of this contract is the mediation of accommodation for fitters.

1.4 The basis of the booking of a fitter's accommodation is the detailed description of the fitter's accommodation based on the information provided by the respective provider. Selection criteria during the online search or in the short text are only for orientation.

1.5 Fitter accommodations presented on the website do not represent a binding contract offer on the part of Stötzer Stadel GbR and/or the respective provider. Rather, it is an invitation to the customer. To make an offer for the conclusion of a contract with the respective provider of the accommodation (invitatio ad offerendum).

The customer makes his offer by filling out the booking form and sending it to Stötzer Stadel GbR. This booking form must indicate how many people (including all children) he is traveling with and whether he is taking one or more pets (indication of species and breed required).

Customer special requests (for example, different arrival time, special equipment, ordering linen, final cleaning and the like) can be entered in the booking order. However, they require the express written confirmation by the provider or Stötzer Stadel GbR to be effective.

The customer is bound to his contract offer for the period of seven days. During this period, the Stötzer Stadel GbR declares on behalf of the provider or the provider itself. Either the acceptance of the offer or transmits a new contract offer to the customer. Which the latter can accept within the period stated therein.

Upon transmission of a booking confirmation or acceptance of the new offer sent by Stötzer Stadel GbR or the provider. By the customer, the contract for the fitter accommodation comes into effect. The contract also comes with the sending of an invoice by the Stötzer Stadel GbR or the respective provider to the customer.

1.6 The brokered contract for the fitter accommodation may be based on the respective provider's own general terms and conditions. These may include terms of payment, provisions on due dates, liability, rebooking, cancellation and other obligations and restrictions of the customer.

Stötzer Stadel GbR provides the general terms and conditions of the provider to the customer in the booking order for inspection and acceptance.

1.7 All contractual components of the booking are stored by the Stötzer Stadel GBR for the settlement of the contractual relationship. Further information can be found in our privacy policy.

2. Booking processing

2.1 Payments

2.1.1 As a rule, a deposit is required by the respective provider upon conclusion of the contract, which is credited to the price of the fitter accommodation. In general, the deposit is due immediately upon booking. Dhe final payment usually 42 days before departure.

For bookings made 49 days or more before the start of the trip, the full rental amount must be paid immediately. Details of the due dates and terms of payment can be found in the booking confirmation and in the general terms and conditions of the respective provider of the fitter accommodation.

The collection of payments is carried out by the provider, by Stötzer Stadel GbR or a service provider used for the collection of receivables.

Insofar as the Stötzer Stadel GbR or a service provider used by it to collect payments invoices the fitter accommodation and collects payments. This is done in the name and for the account of the respective provider. As far as the provider of the mediated service is a tour operator. The customer receives a security certificate or other suitable proof of customer money protection upon payment.

2.1.2 Depending on the provider, payment for the fitter accommodation can be made by bank transfer, by SEPA direct debit from current accounts or by credit card, in exceptional cases also in cash on site. Direct debits will be converted by Stötzer Stadel GbR in principle to SEPA direct debits. For German accounts, the customer will be notified by Stötzer Stadel GbR at least three days before the debit. For foreign accounts at least six days in advance.

For certain payment methods, for example credit card and bank transfer, Stötzer Stadel GbR or the respective provider may charge an additional fee. Possible bank charges for domestic or foreign bank transfer are borne by the customer. Information on the payment methods and fees offered can be found in the details in the booking order and the terms and conditions of the respective provider of the fitter accommodation.

2.1.3 If credit card charges or debits are dismissed or restrained by the executing bank or the credit card company, Stötzer Stadel GBR and/or the provider are entitled to charge chargeback fees to the customer Make. The customer will be notified of the corresponding charges.

2.1.4 If the customer fails to pay payments despite due date, Stötzer Stadel GBR reserves the right to charge a lump sum of three euros for the second reminder.

2.2 Travel Documents

After payment of the full rental or travel price, the customer will receive his travel documents by e-mail from the provider or from Stötzer Stadel GbR 14 days before the start of the journey.

2.3 Contract changes (rebooking, cancellation)

The conditions for contract changes initiated or requested by the customer (for example, rebooking, withdrawal) are governed by the general terms and conditions of the provider.

Stötzer Stadel GbR is entitled to charge these costs to the customer on behalf of the provider. And to collect or retain these amounts from the customer, as far as these costs arise due to changes in the contract. Which are the responsibility of the customer. In addition, Stötzer Stadel GbR charges a flat rebooking fee of 30 euros.

2.4 Transfer of data for the processing of the posted service

Stötzer Stadel GbR collects and uses customer data in accordance with data protection regulations. To process the booking, Stötzer Stadel GbR forwards the personal data entered by the customer to the respective provider.

2.5 Obligations of the customer

2.5.1 The customer is obliged to check the booking confirmation and to inform Stötzer Stadel GbR or the provider of the fitter's accommodation of any errors or discrepancies immediately, but no later than on the third day after receipt. Errors or discrepancies that are not notified shall be deemed to have been accepted.

2.5.2 The customer must contact the Stötzer Stadel GbR or the provider. If, despite full payment of the rental or travel price, he has not received his travel documents at least 14 days before departure. The customer is obliged to check the travel documents for completeness and correctness and to inform Stötzer Stadel GbR or the provider immediately of any missing or incorrect documents.

2.5.3 defects in the mediation service of the Stötzer Stadel GBR shall be notified immediately to the latter; As far as reasonable, there is an opportunity to remedy the issue. If a notice of defects remains culpable, all claims of the customer from the mediation contract are not applicable, as far as a reasonable remedy by the Stötzer Stadel GBR would have been possible for the customer.

2.5.4 Defects occurring during the stay in the booked fitter's accommodation must be reported immediately to the provider on site in order to give him the opportunity to remedy the situation. After his trip, the customer can send the provider another notice of defects in writing.

The address and telephone number of the provider can be found in the customer's travel documents. Legal deadlines are to be observed. 2.5.5 only fully-capable persons are entitled to book accommodation with the Stötzer Stadel GBR.

3. Notes on Passport, visa, foreign exchange and health regulations

3.1 Every customer/traveller is responsible for complying with the valid domestic and foreign entry and exit regulations, health regulations, passport and visa regulations and provisions for the introduction of pets.

3.2 Travel and safety information, entry requirements, health information, visa requirements and similar are available to customers on the website of the Foreign Office available. In addition, clients can obtain information from the embassies/consulates responsible for them.

4. Liability by the Stötzer Stadel GBR

4.1 The Stötzer Stadel GBR is not liable for the success of the mediation and/or the lack-free/actual provision of the fitter accommodation service itself, but only for the fact that the mediation is carried out with the care of a regular merchant.

4.2 Stötzer Stadel GbR shall use reasonable efforts to ensure that the information, software and other data available on the Website, in particular with regard to prices, dates and restrictions, are accurate, current and complete at the time of publication.

The individual details of the holiday accommodations are based on the information provided by the providers. Stötzer Stadel GbR does not assume any liability for this.

4.3 All fitters ' accommodations shown on the website are limited. The Stötzer Stadel GBR is not liable for the availability of a fitter's accommodation at the time of booking.

4.4 Stötzer Stadel GbR assumes no responsibility for the accuracy, completeness and reliability of third-party content.

Especially maps, automatic translations, customer reviews, editorial texts and images about places and regions.

Geodata displayed on the website, in particular map representations, serve only as non-binding orientation about the approximate local position of the offer. Only the local information provided to the customer in the description text of the online presentation and/or in the corresponding booking confirmation shall be authoritative for the conclusion of the contract.

4.5 The exclusions set forth in Sections 5.2, 5.3 and 5.4 shall not apply.

4.8 The Stötzer Stadel GBR is not liable for the consequences of force majeure. 5.3 The contractual relationship between the customer and Stötzer Stadel GbR is subject to the laws of the Federal Republic of Germany, regardless of the nationality of the customer.

The place of jurisdiction for fully qualified merchants, for persons who do not have a general place of jurisdiction in Germany, as well as for persons who have moved their domicile or habitual residence abroad after conclusion of the contract or whose domicile or habitual residence at the time of the is not known is Nuremberg (Germany).
